Terms of Service

FreeFTE is operated by the operator of freefte.com (the "Operator"), established in [EU country of operator]. You can contact us at support@freefte.com.

FreeFTE is a software-as-a-service product that helps businesses plan team capacity, allocations and time off. The service is provided on an "as is" and "as available" basis. We may add, change or remove features over time.

FreeFTE is intended exclusively for business and professional users. By using the service you confirm that (a) you are at least 18 years old, (b) you are using the service in the course of a trade, business, craft or profession, and (c) if you act on behalf of an organisation, you have authority to bind that organisation to these Terms. Consumer-protection laws applicable to private individuals do not apply.

You are responsible for safeguarding your credentials and for all activity under your account. A workspace owner controls who is invited to a workspace and what role (owner, admin, member) each user holds. Workspace admins are responsible for the users they invite and for the appropriateness of the data added to the workspace.

You agree not to:

• use the service in violation of applicable law;
• upload or process special categories of personal data (GDPR Art. 9) — including health, biometric, racial, religious, political or trade-union data — without an appropriate lawful basis and a separate written agreement with us;
• attempt to access data of other workspaces, reverse engineer, scrape, or circumvent security or rate limits of the service;
• use the service to send spam, malware, or content that infringes third-party rights;
• resell or sublicense the service without our written consent.

As between you and us, you (or your organisation) own the data you enter into your workspace ("Customer Data"). You grant us a limited, worldwide, royalty-free licence to host, process, transmit and display Customer Data solely to provide, secure and improve the service for you, and as required by law.

Each party will protect the other's non-public information with the same care it uses for its own confidential information and will use it only to perform under these Terms.

We use commercially reasonable efforts to keep the service available, but do not guarantee uptime on free plans. We may modify, suspend, or discontinue features with reasonable prior notice where practical.

FreeFTE is currently provided free of charge. We may introduce paid plans in the future and will give you prior notice and the opportunity to accept or stop using paid features before any charges apply.

You may stop using the service at any time and delete your workspace from the settings. We may suspend or terminate your access if you materially breach these Terms, including the Acceptable Use section, or if required by law. We will give you a reasonable opportunity to export Customer Data before deletion, except where prohibited.

To the maximum extent permitted by law, the service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy and non-infringement.

To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to these Terms or the service is limited to the greater of (a) the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (€100). We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if advised of the possibility.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for (i) intentional misconduct or gross negligence, (ii) death or personal injury caused by negligence, or (iii) any other liability that may not be excluded under mandatory EU or national law.

You will defend and indemnify us against third-party claims arising from your Customer Data, your breach of these Terms, or your use of the service in violation of law or third-party rights.

These Terms are governed by the laws of [EU country of operator], excluding its conflict-of-laws rules. The courts of [EU country of operator] have exclusive jurisdiction over any dispute, except where applicable mandatory law provides otherwise.

We may update these Terms from time to time. For material changes we will provide notice by email or in-app at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
